  2. So let’s go through the list. Charged: If someone is charged they are formally accused of something either by information or by indictment. So let’s say the police suspect Billy the Hatchet is a murderer. They gather evidence against him and yadda yadda maybe even bring him in for an interview. But until he is formally accused of a crime he is not “charged.”
Indictment: An indictment is a formal accusation of a crime, made by a grand jury. Basically, the way this works is that evidence is presented to the grand jury and the grand jury determines if probable cause exists for a particular crime. If so, they make an indictment. An indictment basically reads like “Billy the Hatchet did intentionally kill his landlady on November 23, 2013 in Such-and-such county.”
Information: An information is a formal charge by a prosecutor. It’s basically the same thing as an indictment, minus the need for that grand jury business. The federal government MUST charge by indictment (see the 5th amendment) but states MAY charge by information.
Arraignment: This is a formal proceeding where the information or indictment is read to the accused. The accused then can enter a plea of guilty or not guilty. The judge will also set bail during this proceeding.
Prosecution: That’s the general term for bringing criminal action against someone. Everything discussed is part of the general concept of a prosecution.
